STANDARD OPERATING POLICY

 

Leave of Absence Policy

 

 

Purpose:           To provide department personnel with various types of approved Leaves of Absences [LOA’s]

 

 

Types of LOA’s

 

The following is a list of the various types of LOA’s. 

 

Medical Leave:

This LOA is available to any active member who has a Doctor certified condition which prevents him/her from fulfilling their designated duties. The injury was sustained in the line of duty.

 

Personal Leave:

This LOA is available to active members who, for personal reasons can not fulfill their obligation to the department.  Personal reasons include but are not limited to change in work status, address relocation, etc.  The LOA is limited to 90 days during a 2 year period.  The minimum period for a personal LOA is 14 days.

 

Military Leave.

A military LOA will be granted while the member is on active duty.  The member must return to on-line status within 1 month of the end of the leave.

 

Educational Leave

This LOA is available to members who are unable to meet their department obligation due to educational commitments.  During school break periods these members can be considered as ‘on-line` if they remain current with rules and regulations concerning Dept. physicals and all required “core” training is keep current within the leave of absences period.

 

Family and Medical Leave:

The Family and Medical Leave act of 1993 [FMLA] states that members may take up to 12 weeks of leave during a 12 month period for the following reasons:

·        Birth of a child and to care for said newborn;

·        Placement of a child into the member’s family by adoption or state approved foster care.

·        The employee is eligible for 26 weeks within a 12 month period to care for an Armed Forces member who was injured.

·        To care for the member’s spouse, child, or parent who has a serious health condition. or

·        A serious health condition that renders the member unable to perform the functions of their FD position.

·        ‘Serious health condition” means illness, injury, impairment, or physical/mental condition that involves a hospital stay, hospice, a stay in a residential medical care facility, or continuing care by a health care provider.

·        The 12 month period in which the FMLA is taken will be determined by using the start date of the 1st FMLA leave and counting forward.

 

 

Procedure

1.      The member shall submit a letter to his or her captain requesting a LOA and the specific time period...

2.      The captain will forward the letter to the Department Personnel Officer for review; it will then be forwarded to the Chief for approval.

3.      A request for Medical LOA’s shall have appropriate documentation from the physician.  A Dr’s note will be is also required to terminate the LOA.

 

Note               

·        LOA’s are available to members who have fulfilled their duties as outlined in the “operating rules for the fire division section IX.

·        Members will be required, within 90 days of their return, to make up all mandatory training missed during said leave.

·        Members who are on a Military LOA will be considered “Off-Line’ until their military obligation is complete.

·        All FD equipment shall be returned to the company captain while the member is on LOA
